I often have clients asking me how long Australian Visa processing times will be once they have lodged their application with the Australian Embassy. There are many variables to take into account when I answer this question.

1) Each Australian Visa case is assessed on its own merits therefore each case is different and will be subject to different processes, for example, applications which may appear to have false information or documents provided will take longer for the case officer to have the documenets authenticated
2) A well organised and completed application will make for an easier Australian Visa application to assess by the Department of Immigration Case Officer. Providing all the documents at the outset will mean the case officer will not have to make repeated requests for information nor wait for the information to be gathered and provided. It is my job as an Australian registered migration agent to make sure your application is well prepared.
3) It all depends on where you are lodging your application and what type of application it is. You will find most Australian Embassies will advertise processing times on their websites as an average processing time. It could mean your application will be assessed more quickly if it is very well prepared. That is my job as an Australian registered migration agent is to make sure you application is well prepared!

I just had a question in relation to a 886 visa. The question is three pathway - there is no mention of recent work experience requirement for subclass 886 if the person holds a 485 Visa.

Can you please comment .

The legislative requirements for the subclass 886 visa are the same for everyone regardless of what qualifying visa you may be currently on.

For the time being you will need to wait to find out if you will be one of the people who will have their bridging visa cancelled. The bill is only going through parliament at the moment to allow the Minister this power to cap and cease GSM applications in the pipe line. It hasn’t started happening yet. It will only be for people who have an occupation for which the CAP limit has been reached. We haven’t been advised of what these caps are as yet so we don’t know how this will affect certain occupations.

If you are someone who this happens to I suggest you get in contact with me and we can work out if you have any other visa options at that point. I recommend it could be worth your while to in the meantime try and find an employer willing to sponsor you. If you do I can assist with an employer sponsored application. Thanks for your enquiry. If you have applied for the 485 you should have been “saved” by the transitional arrangements, however, DIAC did cancel many visas that were in the pipeline earlier this year and we have seen by recent sweeping changed implemented by the Department of Immigration and Citizenship with such things as the new Skilled Occupations List that we cannot predict the future of Australian Immigration. If you have an employer willing to sponsor you I highly recommend you look at applying for an employer sponsored visa. I can assist with employer sponsored visas – email me your CV if you like. Hi ,
I competed my masters in ICT managemnet in july 2009. I applied my 485 graduate visa in august 2009. My agent did a big mistke. She nomimated my occupation as an accountant in the application form although she attached the ACS positive skill assesment .It was a typing error. I found it in jan 2010 tha she did this mistake. I changed my agent and filled incorrect answer form 1023 immediatly. My new agent filled my correct occupation as recent ICT graduate.
NOw on 19th of may I got case officer. He requested for personal documents as PCC,Form80,Marriage certificate.
I submitted all on 03 june 2010.
I am still waiting for the approval . I met all the requirements.
I am very upset about that mistake my agent did although i fixed it before the allocation of case officer. Can you please tell me why he is taking it so long to make the decision.....?

If you already have a migration agent then you should check with your migration agent in regards to what is delaying your application. It may be taking additional time due to them verifying your relationship to ensure your partner meets the requirements to be included in your application and also the form 80 is the character check requirements form and usually we provide this at the beginning of the process so it doesn’t cause delays, it sounds like due process but things have been held up due to errors made and forms not being submitted that should have been submitted when your application was lodged, for example your marriage certificate.

If you already have hired a migration agent I cannot assist you or provide migration advice due to my code of conduct requirements. However, if you do not have an agent you could hire us to follow up with the case officer, ensure things are now correct and everything will run smoothly until the finalisation of your case. We can also liaise with the case officer in regards to processing times and find out a more accurate estimate for you.

This is not highly unusual. If I were acting on your behalf I would be following up with the Embassy to find out where your acknowledgment letter is, get your file number and find out who your case officer is. You could also check the processing times for partner visas at the Australian Embassy in Berlin, go to www.dfat.gov.au and click on Berlin.

If your case is with the MRT and they decide to remit your decision they will send the case back to DIAC to re look at your case. I could not tell you if or how capping would affect you without looking into this further and spending time researching as this is not a situation I have come across and I cannot give you migration advice unless you book a consultation. I would suggest if you have hired an agent to represent you at MRT you ask them to follow this up for you. If you need representation we can assist.

I am not sure where you have read the information the Australian Government has cancelled the cease and cap legislation. They cannot cancel legislation, they have to pass new legislation to override the old legislation. Currently in Australia due to the upcoming election the Government is in a caretaker mode which means they cannot make any new decisions until the elections are over. So please let us know where you have heard this information so I can try and verify it for you but it does not sound correct to me.

Hi Priya,

There is not a lot you can do I am afraid at this stage except get in touch with your migration agent if you have one to follow up with the case officer. Your agent or you can actually try and contact and find out where it is at.

Did you know if you send a blank email to aspc.processing@immi.gov.au you will get back information about the processing times for skilled visas.

The only way you can speed up the process is if you find an employer to sponsor you and then lodge an employer sponsored visa. We have contacts with recruitment companies who can assist you to find sponsors.

If you already have hired a registered migration agent I would speak to them about it. When you apply for a visa that requires you have a certain amount of work experience you need to be able to prove that you earned the money and you were employed. If you are not able to provide evidence you were paid you may be in a position where your visa is refused. I highly recommend you speak to your migration agent about this issue. Usually you need payslips, tax returns and a letter from your employer.

Dear Seema

Skilled Graduate 485 visas are processed in the order of which they are lodged. These visas are exempt from priority processing arrangements. This means you will be able to be legally able to stay in Australia on a bridging visa until the outcome of the 485 visa.

Currently the Department of Immigration are processing 485 visas that were lodged on 5 August 2009 are currently being processed – this means your application is roughly 5 months away from processing.

Are you aware of the changes made to skilled migration program on 1 July 2010? Do you know if you are eligible for a visa with the new changes? I suggest you book in for a consultation with us to work out if you are eligible or how you can become eligible to continue on your pathway to permanent residence in Australia.

Did you actually receive a letter telling you that you have been affected by visa capping and ceasing?
If you have then I suggest you contact me by email and I can see if you are eligible to lodge another applicaiton and start from the beginning.
Anyone who received one of these letters has had their visa application cancelled and you have to write to request a refund of the fees you paid to the Department. I know many people were looking at starting a case against the Department to argue against the decision, but this has to be done individually. Please email me if you want to see if you are currently eligible. In regards to whether the legislation to do this has been amended I would suggest you would have received another letter if this was the case. I would have to do some checking myself as I am not aware the decision was reversed.

Apologies I realised I missed your post.
Have you had any outcome for your 886 visa. As far as I know Chemical Engineers were getting through the process fairly quickly, however, it depends on the priority processing arrangments. People with family sponsors and state sponsors were higher up the priority processing list.

Hi,
I got thru my positive TRA in Sept 2009, SA state sponsorship granted in Oct 2009. My application for PR lodged with DIAC on 16 March 2010.
My occupation remains on the new SOL. I have submitted all necessary documents such as PCC, health requirements, IELTS through my migraton agent based in Australia. She does give me feedback's when I call to inquire, but with the care taking Govt in place she told me things will get moving only afterwards. Can you give me an idea as to when I can expect my PR please? Would be so grateful to have a second opinion.

My brother have Australian citizenship however he has been living in Singapore since couple of yrs. While i checked online, it showed that my process has been commenced last wk. I was wondering whether it will affect my processing or not that my brother is living in singapore from past few yrs. Will it be god idea to ring immigration office to make sure about it? Or is there anything that you could suggest me at this stage.

Thanks for your enquiry. Your brothre as your sponsor is required to be a Australian Citizen or an Australian Permanent Resident. If he is an Australian Citizen that is fine, however, if he is a Permanent Resident he just have to make sure it is still current and he is within the 5 year period of his PR grant which allows him to travel in and out for that first 5 years. After that he needs to apply for a Resident Return Visa.

We are offering a new service to anyone who has lodged a general skilled application and would like to have an agent check their file after lodgement to make sure everything is there and complete a decision ready checklist.

We have to check the documents before we can sign off on the checklist but ultimately it is a special service offered to registered migration agents whose clients have lodged decision ready applications, it means their applications can be processed more quickly than applications without the decision ready checklist.

Hi I am an Australian citizen living in Australia, living apart from my husband in Canada while we await the outcome of our spousal visa application. My husband and I lodged his visa application with the Australian embassy in Ottawa 5 July.

We still haven't received a case officer, and are concerned that there will be a delay due to the caretaker government in Australia. My husband would like to come over for a short visit on a visitor's visa while his application is being considered. Is this possible? And how do we contact anyone without having a case officer?

Any assistance in this matter would be greatly appreciated!

When I represent people when lodging spouse visa applications I usually liaise with the Embassy to organise approval for lodgement of a tourist visa with the case officer once the case officer has been assigned. I am surprised you haven’t been advised of your case officer as yet. Caretaker government has no effect on applications already lodged. I can tell you this as I have over thirty current active spouse visa applications with several different Australian Embassies and none are on hold.
You might want to considering hiring us to follow up with the Embassy, ensuring everything is in order and get things moving plus organise the tourist visa so you husband can join you here in Australia as soon as possible. He will need to leave even if for a day when the case officer is ready to grant – just go somewhere close like New Zealand for example. A question on 485 visas.

I got the impression from a housemate that a guy at his work got his 485 application rejected randomly. In other words, there are too many people applying and so they decide to reject your application even though you had everything in order.

Is this an accurate assessment of how things are at the moment? I thought that because I had studied for more than 2 years in Australia and have all my ducks in a row with regards to my visa application that I should be fine.

Should I be worrying?

I cannot comment on why your friend’s visa application was rejected. If he wants to get a professional opinion you can tell him to email me.

In regards to your application if you have lodged all the required documents and you meet the criteria your application should be approved.

Hi !

My name is Vivian, I live in brisbane...on 25th of august I had a MRT hearing for my 457 Visa. We supplied with all the documents which were not included during the lodgement of my visa last year ( thats coz of my agent's fault, he messed up big time and has a habbit of forgetting things and didnt submit the required documents as per the rules and regulations)

anyhow the reason why my visa application was refused was the business not being an approved sponsors, there was no training plan in place and the case officer at dimia was not happy with the companys financial statement.

on 25th august the tribunal member asked for a detailed financial statement which should show a split of wages. Showing super, wages, and wages spent on training , the member being very kind and understanding the fact that my bosses business is not a big business and that the my previous migration agent screwed up gave us 7 days to submit this financial statement which should show a split of wages and wages spent on training. he was fine with rest of the things presented and discussed during the case hearing ....he said after he recieves the financial docs he will take two weeks to finalize my case.

Do you reckon this is a good sign ? or does MRT usually takes 2 weeks time to decide and send its decision by post ?

Most of my friends said that if the member had to refuse my case he would have done it straight away, but coz he understood the facts which we gave him about the preious agent not being supportive and that he messed up the case, plus understood the fact that we are a medium scale business he gave us 7 more days.

have anyone of you been through this before or is this a general procedure for taking 2 weeks time to send the decision by post ? Do I have a chance to get my 457 visa ? should i keep my fingers crossed or ?

what happens after the applications is remitted ?

Hi, I lodged my app 886 Aug 2008 and have just recieved a case officer. They have asked me to supply a lot of info that I have already submitted like skills assessments and medical. I am not sure why I am a primary teacher and I noticed that the assessors are no longer teach Australia is this due to the recent changes? Also I have been allocated a different case officer and was not even advised about the first this is now my second pm app and I can't afford any more hassle can you help me out?
